1. USE OF THE WEBSITE

Welcome to Fashion Clinic’s official online store.

Fashion Clinic is a trading name for Amorim Fashion S.A, a Portuguese company registered in Lisbon Commercial Company Register (Registro Comercial de Lisboa), under registration and VAT number 507405340, with registered address in Avenida da Liberdade no. 180 E, 1ºEsquerdo, Sala D, 1250-146 Lisbon, Portugal.

These Terms and Conditions together with the information and policies contained in the Customer Assistance pages set the legal terms that regulate the access and use of FASHIONCLINIC.COM.

By accessing this website you shall acknowledge and agree with these Terms and Conditions.

If you do not agree you may not use this website and should leave it immediately. If you continue to use the website or if you place any order of products, it will be considered that you acknowledge, consent and accept  these Terms and Conditions.

When we refer to “we”, “us”, “our” we mean FASHIONCLINIC.COM. When we refer to “you”, “your” we mean you, the person using the services displayed by Fashion Clinic’s official online store.

These Terms and Conditions may be amended from time to time, so we kindly ask you to check the website regularly and please ensure that you understand the legal terms.

In order to be eligible to purchase items on this website you must:

a) be the holder of a valid credit/debit card;

b) be over 18 years;

b) secure that the personal information that you are required to provide when you register as a customer is genuine, accurate and updated in all aspects.

 

2. THE PRODUCTS

We do all the best efforts to ensure that the items displayed in this website are as accurately as possible. However, we cannot ensure that any descriptions and prices are totally error free and that your computer displays accurately the colors of our products.

If an error is noticed in the price of any product ordered by you, we will inform you as brief as possible and shall give you the option to reconfirm your order at the correct price or to cancel it.

 

3. THE PURCHASE

At the moment of the placement of your order at FASHIONCLINIC.COM you are accepting to purchase the selected items at the stated price.

Note that until such order, all the items in your shopping bag are not reserved and may be meanwhile purchased by other customers.

By placing an order you also agree that all the information provided by you is  genuine, accurate and updated, that you are over 18 years old and that you are an authorized user of the credit or debit card used in the transaction and that the respective bank account has sufficient funds to cover the total amount of the order.

 

We may not accept your order if:

a) The selected item is out of stock;

b) Errors are noticed on the product or price;

c) Your credit/debit card is due to expire within 28 days of the date of your purchase;

d) We are unable to obtain authorization for your payment.

We also reserve the right to reject any offer to purchase at any time and at our sole discretion.

If by any reason we are unable to comply with your order after its confirmation, you shall be contacted and informed by email or telephone.

 

3.1. Order Confirmation

Once you have placed an order you will receive an email acknowledging such order and respective details. Such email does not correspond to an order confirmation or acceptance of the same by FASHIONCLINIC.COM.

Neither our third parties payment processors, nor the designated courier agent have the authority and empowerment to accept orders on behalf of FASHIONCLINIC.COM.

The acceptance of your order and the completion of the transaction will take place and shall be effective at the date in which you receive an email from our Customer Service notifying the dispatch of your order.

 

3.2. Prices

Prices are displayed in Euros and are inclusive of VAT at the applicable rate.

Delivery costs are not included in the prices of the products displayed in our online store, but they will be informed at the end of your order form on the checkout process.

 

3.3. Payment

FASHIONCLINIC.COM accepts debit (when the issuing bank allows “card not present” payments) and credit cards from Visa and MasterCard systems. When selecting this payment method you will be throughout the entire checkout process at our site, however your credit card details will be submitted directly from your browser to the PCI-DSS certified secure INGENICO e-commerce Solutions SAS servers when you submit your order. A standard pre-authorization check on your payment card shall be carried out and the products will only be dispatched once this process is completed and if the payment is authorized. You shall be required to confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. If the issuer of your payment card refuses to authorize payment to FASHIONCLINIC.COM, we will not be liable for any delay or non-delivery of the products.

You can also choose to pay through PayPal. When selecting this method you will be directed to the PayPal site “Log in” and please confirm the amount before clicking “Pay Now”. When this transaction is complete you shall return to FASHIONCLINIC.COM.

 

4. DELIVERY

At the moment FASHIONCLINIC.COM only delivers products to Portugal. If the delivery country of your choice is not Portugal, you will be informed  at the point of ordering that we don’t ship to the chosen country.

Deliveries to post offices or other agents shall not be acceptable and executed.

Delivery time period is estimated and cannot be guaranteed as may vary depending on the availability of the products and of your selected delivery address.

FASHIONCLINIC.COM shall make all the efforts to secure that your order is delivered at the place and to the person of your choice, in perfect conditions and in the shortest possible time.

FASHIONCLINIC.COM delivery charges calculation shall be based on the size, weight and destination of your order and shall be summarized on the order summary page.

An acceptance signature shall be required at the delivery of the order.

If you wish to track your order please refer to the email containing your tracking number.

 

4.1. Events outside our control

Events outside our control shall be considered as produced or occurred in case of acts or events that are beyond our reasonable control, such as and without  limitation, war (declared or not), civil disturbance, revolution, riot, governmental measures, strike, blockage, terrorist attack, epidemics, fire, explosion, telecommunications failure, inability to use any means of transport, private or public, natural disasters and adverse weather conditions.
If such events affect the performance of our obligations, FASHIONCLINIC.COM shall not be liable or responsible for any failure to perform or delay in performance of any our obligations, including and without limitation, displaying of products and acceptance of orders or deliveries. Our obligations may be suspended and if deliveries are affected by such events, case in which and a new date of delivery shall be arranged, if the performance of our obligation was not definitely and totally affected.

The contract between you and FASHIONCLINIC.COM may, in such cases, be partially or fully terminated by either party if the event persists for more than 30 (thirty) days.
In any of these cases we FASHIONCLINIC.COM shall do the best to solve any related matters, as soon as possible.

 

4.2. Insurance

All items are insured against robbery and accidental damages whilst in transit from our warehouse to the shipping address. Once your items have been delivered to the specified delivery address and signed for, they are no longer covered by insurance. If your box is damaged upon arrival, we recommend that you either refuse the delivery, or insert a note on the damaged box on the acceptance documents of your order. If in your order you have specified a different recipient for delivery purposes you are accepting that the signature of the order acceptance documents by such recipient  constitutes evidence of delivery and fulfillment by FASHIONCLINIC.COM of all the obligations associated to such order and delivery and transfer of responsibility in the same way.

 

5. RETURNS AND EXCHANGES

All orders are carefully checked and controlled by our packaging team, before being dispatched. If by any chance you receive a damaged item, please contact us immediately to customerservice@fashionclinic.com.

FASHIONCLINIC.COM offers a flexible returns policy, as your satisfaction is our top priority. However, we do monitor the number of returns made and may refuse to accept orders at our discretion if goods are returned repeatedly.

We hope you are enchanted with your order, but if by any reason you are not perfectly satisfied you have 14 (fourteen) days to decide and inform us on your decision on returns and exchanges.

Please read our Returns & Exchanges Policy carefully to ensure that you can proceed with your request and actions as quickly as possible.

 

As you are in the EU you have the right to cancel your order under the Consumer Contracts (Information, Cancelation and Additional charges) Regulations 2013.

 

If in the above mentioned term of 14 (fourteen) days you decide to return or exchange your order, you may simply request a Return Authorization Number (R.A Number) by sending an email to customerservice@fashionclinic.com. Please inform us in the same email if you want to return your item directly in store or if you want us to book a collection with our courier partner – DHL.

If you decide to return your item in store:  Please chose the most convenient one by visiting our “stores” page, and inform us in the Return Authorization Request email.

If you decide to return by DHL: You must inform us of your decision in the Return Authorization Request email and we will take care of the return procedure by contacting our DHL service to book a collection, which will allow you to send your item back to FASHIONCLINIC.COM;

Please, prepare your package so it can be provided to DHL driver for pick-up along with our invoice, and fulfill DHL documents with all the required information. Your package shall be therefore ready to be returned to FASHIONCLINIC.COM. We shall not be liable for any returns executed by a different courier.

Note that all returns must be sent back in the original packaging and the items should be returned unworn and in perfect condition, with all FASHIONCLINIC.COM and designer garment tags still attached. Returns that are damaged, soiled or returned without their original labels and tags may not be accepted and may be sent back to the customer.

When designers packaging such as authenticity cards, dust bags and leather tags are provided along with your selected items, these must be included in your return.

Footwear should be returned unmarked and in its original and undamaged packaging as this is considered part of the product. Technology products should also be returned in the original packaging. Briefs, swimwear and bikini bottoms should be tried on over underwear. Returns may not be accepted if the strip has been removed or if the items are soiled, and may be sent back to the customer.

 

6. PROMOTIONAL CODES

You may occasionally receive promotional codes via email or through promotional materials.

In case of FREE SHIPPING campaigns, any taxes or  duties.

Each code is exclusively attributed to each recipient and cannot be transferable to any third party or individual. Promotional codes have no monetary value and under no circumstances can be converted into currency. If a code has an expiry date, it will be stated at the time of the launch of the promotion or on accompanying promotional materials which cannot be modified

The refunds of promotional purchased items shall correspond to the promotional price of each item. The discount will not be refunded and only one promotional code can be used per order.

 

6.1. Non-cumulative discounts

During Sales season only one discount is allowed in each purchase, that is why "Sales discounts” and "Promocodes" are non cumulative.

 

7. COPYRIGHT AND TRADEMARKS

FASHIONCLINIC.COM does not grant you rights in relation to any copyright designs, trademarks and all other intellectual property and material rights relating to the contents (such as texts, graphics, logos, icons, images, audio, video)

All rights and contents of this website are protected by national, EU  and international intellectual property law and international treaty provisions.

The reproduction by any way, form or support of any content of this website is prohibited and may result in civil and criminal liability and penalties.

 

8. THIRD PARTY SITES

We may include hyperlinks to external websites other than FASHIONCLINIC.COM, including advertisers. We are not responsible nor do we assume any liability for the contents, actions, products or services of any off-website pages or of such external websites.

 

9 .LIMITED LICENCE

You have a limited, revocable and non-exclusive licence to access and make personal use of the website and therefore you accept and agree that you are personally responsible for the use of the website. If you take a prohibited conduct or a disrespectful conduct towards other users, we may temporary or permanently block your access to FASHIONCLINIC.COM.

 

10. RIGHTS AND LIABILITIES

You are entitled to order products and such products are to be of satisfactory quality. However, if a product is defective you will be able to take action.

You are also entitled  to cancel any order within 14 (fourteen) days after the date of receipt of the product and be fully refunded, even if the product is not defective (except for the product return associated costs).

We shall be responsible for foreseeable losses or damages  arising from our breach of these terms and conditions or in case of negligence. We shall not be responsible for any losses or damages that are not foreseeable. A loss or damage is to be considered as foreseeable if it is expected and obvious to occur or if, at the time the conclusion of the contract, both you and FASHIONCLINIC.COM knew it might happen.

We shall not be responsible for any direct or indirect losses and damages that were not caused by us, even negligently, and that could not be reasonably foreseen by you and/or FASHIONCLINIC.COM. Our responsibility and liability shall be excluded when the failure to comply with our obligations is due to events beyond our reasonable control.

You agree that we are not responsible or liable under any circumstances for any computer viruses, system failure or malfunction which may occur in connection with your use of the website, including hyperlink to or from their parties.

 

11. COMPLAINTS

If you have a complaint about FASHIONCLINIC.COM or any of the displayed products, please submit it by email customerservice@fashionclinic.com and provide all the details including date of purchase, other reference number and your full name and contacts.

 

12. GOVERNING LAW

These terms and conditions are governed by Portuguese law. The competent Portuguese Courts shall have exclusive jurisdiction over any dispute or claim relating to these terms and conditions and execution of the contract.

 

13. GENERAL

If any provision of these Terms and Conditions is considered as unlawful, invalid or unenforceable, in whole or in part, all the remaing provisions shall continue to be valid and enforceable as well as the remaining part of the affected provision.

We reserve the right to change and complete these terms at any time. Please revisit these terms periodically to ensure your knowledge and awareness.
